All other trademarks not owned by Gathered Home that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or otherwise related to Gathered Home.

LICENSE AND ACCESS

Subject to your compliance with these Terms and Conditions, Gathered Home or its product suppliers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Site. This license does not include any resale or commercial use of any Gathered Home service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any of the contents of the Site; any downloading, copying, or other use of personal information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms and Conditions are reserved and retained by Gathered Home and its licensors, suppliers, publishers, rightsholders, or other product or content providers. The Site, or any part of it, may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of gatheredhome.com. You may not frame or use any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Gathered Home without express written consent. You may not use any meta tags, metadata, or other “hidden data” using Gathered Home’s name or trademarks without the express written consent of Gathered Home. You are expressly prohibited from misusing the Site in any manner. You may use gatheredhome.com only as permitted by law. Gathered Home reserves the right to terminate any license it grants you if you do not comply with these Terms and Conditions.

YOUR ACCOUNT

If you choose to register an account on the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Gathered Home may occasionally sell products intended for children, but it sells them only to adults, who can purchase them with a credit card or other permitted payment method. If you are under 18 years of age, you may only use the Site with involvement of a parent or legal guardian. Gathered Home reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

Visitors may occasionally be permitted to post reviews, comments, photos, videos, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing upon intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages that Gathered Home in its sole discretion shall characterize and act upon.

If you do post content or submit material, and unless Gathered Home indicates otherwise, you grant Gathered Home a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media of any form. You grant Gathered Home and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Gathered Home for all claims resulting from content you supply. Gathered Home has the right but not the obligation to monitor and edit or remove any activity or content. Gathered Home takes no responsibility and assumes no liability for any content posted by you or any third party.

COPYRIGHT COMPLAINTS

Gathered Home respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement and is present on Gathered Home, please follow the notice and procedure for making claims of copyright infringement at the end of these Terms and Conditions.

RISK OF LOSS

All items purchased from Gathered Home are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the shipment carrier.

RETURNS, REFUNDS, AND TITLE

Gathered Home does not take title to returned items until the item arrives at our facility. At our discretion, a refund may be issued without requiring a return. In this situation, Gathered Home does not take title to the refunded item. For more information about our returns and refunds, please see our Returns Policy at the end of these Terms and Conditions.

PRODUCT DESCRIPTIONS

Gathered Home attempts to be as accurate as possible. However, some products may differ from what is depicted in their respective photographs shown on the Site due to their natural, handmade, vintage, or otherwise unique nature, and Gathered Home does not warrant that product descriptions or other content of any product is accurate, complete, reliable, current, or error-free. If a product offered by Gathered Home is not as described, your sole remedy is to return it in unused condition.

In addition, we have made every effort to display as accurately as possible the colors of the products shown on the Site. However, due to reasons including but not limited to differences in the quality, size, resolution, and individual user settings of every user’s computer monitor and video card (graphics processing unit), in addition to individual settings in any color-enhancing or -altering software one may use, we cannot guarantee that the actual color of any product will be as it appears on your particular monitor.

PRICING

Except where noted otherwise, the List Price or Suggested Price displayed for products on gatherehome.com represents the full retail price for the product, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price or Suggested Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that may be offered as a set, the List Price or Suggested Price may represent “open-stock” prices, meaning the aggregate of the manufacturer’s estimated or suggested retail price for each of the items included in the set. Where an item is offered for sale by any merchant affiliated with Gathered Home, the List Price or Suggested Price may have been provided by the merchant.

No adjustments on price will be made on previously purchased items.

With respect to the items sold on gatherehome.com, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items on the Site may be mispriced. If the correct price of an item we sell is higher than the stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. We generally do not charge your credit card or other payment method until after your order has entered the shipping process.

We reserve at all times the right to correct any errors, inaccuracies or omissions, and to change or update information that may relate to pricing, promotions, offers, descriptions, services, shipping charges, transit times, and availability.

OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the Site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the Site (including the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

SOCIAL MEDIA AND CONTESTS

Gathered Home will from time to time make use of social media including, but not limited to, Facebook, Twitter, Pinterest, or Instagram to advertise products and services, and to solicit people to the Site. Any image, video, text, or other means of communication you post to any such social media on your own personal account involving a product or service Gathered Home offers, if Gathered Home is otherwise authorized to access your social media page, may be used in connection with Gathered Home’s own social media accounts.

In addition, Gathered Home may from time to time and in its sole and unqualified discretion announce contests for prizes involving products and services on the Site pursuant to the following rules:

Entrants must send entries as required in the particular contest announcement in order to be eligible. Entries received after the deadline set forth in the contest announcement are ineligible, null, and void. Gathered Home is not responsible for and will not consider incomplete or incorrect entries. Gathered Home is not responsible for entries that are sent but not received by Gathered Home for any reason.

All winners will be notified by the form or method of contact they provided to Gathered Home when they sent their entries.

If the winner does not respond to the notification within: a) five (5) business days for contests entered via a form, email, or mail; b) twenty-four (24) hours for contests entered via social media; or c) twenty-four (24) hours for contests entered via text messaging, another winner will be chosen. Failure to respond within the time frames listed above shall be deemed forfeiture by the tentative winner.

Only one entry per person will be considered for contest entry unless the contest announcement specifically says that multiple entries are allowed.

All photos, drawings, text, video, and any other content or information in any form (“Materials”) you submit to Gathered Home shall become the sole and exclusive property of Gathered Home, and Gathered Home shall have no obligation to compensate you for, preserve, return, or otherwise make available to you or others any Materials.

Gathered Home may use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish, and otherwise make use of Materials in any and all media, whether now known or hereafter created, throughout the world and for any purpose, without compensation to you of any kind.

By submitting Materials to Gathered Home, you represent and warrant that the Materials do not infringe any copyright, trademark, property rights, rights of privacy, rights of publicity, or any other intellectual property of any person, or any other right of any third party, and that you have the full and unrestricted right to transfer the Materials to Gathered Home free and clear of any claims or encumbrances.

You acknowledge and agree that Gathered Home shall have no obligation to post, display, or otherwise make publicly available any materials you submit to us.

You acknowledge and agree that Materials submitted by you may be made available by Gathered Home for viewing, rating, reviewing, and commenting by the public. You acknowledge that comments, ratings, or reviews with which you disagree or are unhappy may be published or otherwise become associated with Materials that you submit to Gathered Home. By submitting Materials to Gathered Home, you waive any privacy expectations that you may have with respect to the Materials.

You agree to hold Gathered Home and its officers, directors, employees, agents, successors, and assigns harmless from and against, and hereby waive any right to pursue, any claims or causes of action of any nature arising in connection with Gathered Home’s use of the Materials you submit to Gathered Home and used in any manner in Gathered Home’s sole and unqualified discretion.

Contests involving evaluations of Materials you submit as part of the contest will be judged entirely in the sole and unqualified discretion of Gathered Home. Gathered Home’s decisions are final.

All entrants and winners must be at least 18 years of age, unless otherwise stated or posted.

Winners may not request substitutions of prize winnings. All winners are solely responsible for any and all taxes and/or fees as well as all additional costs that may be incurred.

Neither Gathered Home nor its officers, directors, employees, agents, successors, or assigns shall be liable for any warranty, costs, damage, injury, or any other claims incurred as a result of the usage of a prize by any winner including but in no way limited to each and every aspect of the nature of the prize. Gathered Home is not liable for any loss out of or in connection with any contest Gathered Home promotes.

If the specified prize becomes unavailable for any reason, Gathered Home in its sole and unqualified discretion may substitute a prize of like kind or equal value.

A contest is null and void in any jurisdiction where prohibited by law.

Gathered Home reserves the right in its sole and unqualified discretion to alter any contest rules or prizes at any time.

Gathered Home reserves the right in its sole and unqualified discretion to terminate any contest at any time without notice.

By entering a contest, you are conclusively deemed to have agreed to be bound by these contest rules and terms and conditions as well as by any rules specific to such contest. This is an irrevocable condition of entry.

The following non-exhaustive criteria apply:

• In contests in which winners are selected at random, the odds of winning depend upon the number of entries received and cannot be determined in advance;
• In contests in which winners are selected based upon skill or accomplishments, winners will be chosen by Gathered Home on the merits of each entry, in Gathered Home’s sole and unqualified discretion;
• In contests in which winners are selected on the basis of being the nth person to complete an action stated in the contest announcement (e.g., “The tenth person to comment on the post will win.”), the winner shall be that nth person provided that he or she validly completes the action, validity being determined by Gathered Home in its sole and unqualified discretion;
• In contests and polls in which Gathered Home solicits votes by the public to help decide the winner, while the results of such polls may be a considered factor in determining the winner, the winner will ultimately be selected by Gathered Home in its sole and unqualified discretion.
• No purchase or payment of any consideration is necessary to enter contests.

Except in the case of contests in which winners are selected on the basis of being the nth person as outlined above, each contest will state a deadline for entry and the date when winner(s) will be announced. Winners of contests run on the basis of being the nth person as outlined above will be timely announced after the action is completed. A list of winner(s) may be obtained by sending a self-addressed, stamped (first-class postage) envelope to Gathered Home and requesting the list.

Gathered Home reserves the right to condition the award of prizes upon the execution by the winner(s) of a publicity release statement. Notwithstanding this right, entry is conclusively deemed to be permission by the entrant to use the entrant’s name and likeness (without compensation to the entrant) if the entrant is a winner to publicize the contest and otherwise, as determined by Gathered Home, unless otherwise prohibited by applicable law.

Gathered Home reserves the right to require the winner to execute an affidavit of eligibility as a sworn document and provide other proof of eligibility as a condition of receipt of a prize or award.

SMS/Text Message Contest Rules

FOR CONTESTS THAT PERMIT ENTRY VIA TEXT MESSAGE: NO PURCHASE OR USE OF WIRELESS SERVICE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR USE OF WIRELESS SERVICE WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED.

The text messaging method of entry will be designed to work with most of the major wireless carriers in the United States, but Gathered Home makes no guarantee that any particular wireless service provider will participate, and the mobile phone that is used must be capable of sending and receiving text messages.

Participants should check their phone’s features to see if they have that capability. Wireless service providers may charge participants for each text message, including any error message that is sent and/or received in connection with the contest.

Participants should consult their wireless service provider’s pricing plans for details. You may receive reply messages.

Participants are solely responsible for any wireless charges. Not all wireless carriers may participate.

Unless otherwise provided, all entries must be received and recorded by the contest’s stated end date, and Gathered Home’s designated official judge is the official timekeeper for any contest.

We provide links to the sites of both affiliated and non-affiliated companies and certain other businesses on the Site. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their websites. Gathered Home does not assume any responsibility or liability for the actions, products, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

REFUSAL OF SERVICE

We offer products to you subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the Site, subject to our fulfilling our previous responsibilities to you based on acceptance of your payment prior to any such change of discontinuance.

INDEMNIFICATION

You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the Site. You shall provide us with such assistance, without charge, as we may request in connection with any such defense, including, without limitation, providing us with such information, documents, records, and reasonable access to you, as we deem necessary. You shall not settle any third party claim or waive any defense without our prior written consent.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE SITE AND ALL CONTENT, MATERIALS, PRODUCTS AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY GATHERED HOME ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. DISPUTES

Any dispute or claim relating in any way to your use of the Site, or to any products or services sold or distributed by Gathered Home, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms and Conditions as a court would.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent, Kelsi Kitchen, 3245 University Ave. Suite 1 #220, San Diego, CA 92104. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. You may choose to have the arbitration conducted by telephone, based on written submissions.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

GOVERNING LAW; VENUE; MEDIATION

These Terms and Conditions shall be construed in accordance with, and governed by, the laws of the Federal Arbitration Act, applicable federal law, and the laws of the State of California as applied to contracts that are executed and performed entirely in California. The exclusive venue for any arbitration or court proceeding based on or arising out of this Agreement shall be San Diego County, California. The parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms and Conditions by mediation, which shall be conducted under the procedures upon which the parties may agree. The parties further agree that their respective good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration, or other dispute resolution procedures.

RECOVERY OF LITIGATION EXPENSES

If any legal action or any arbitration or other proceeding is brought for the enforcement of these Terms and Conditions, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of these Terms and Conditions, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

EFFECT OF HEADINGS

The subject headings of the paragraphs and subparagraphs of these Terms and Conditions are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

ENTIRE AGREEMENT; WAIVER

These Terms and Conditions constitute the entire agreement between you and Gathered Home pertaining to the Site and supersede all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of these Terms and Conditions by Gathered Home shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by an authorized representative of Gathered Home.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our Privacy Policy, posted on the Site. These policies govern your use of the Site. We reserve the right to make changes to our site, policies, and Terms and Conditions at any time without notice. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

How to Serve a Subpoena

If you have a subpoena to serve on Gathered Home, please note that Gathered Home does not accept service via email or fax and will not respond to the subpoena if sent in those manners. All subpoenas must be properly served on Gathered Home, preferably by mailing the subpoena to Kelsi Kitchen, Gathered Home’s registered agent, at the address noted above.

Notice and Procedure for Making Claims of Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please submit your complaint in writing to the address noted above. Please provide us with the following information:

A physical signature of the person authorized to act on behalf of the owner of the copyright interest;

A detailed description of the copyright work that you claim has been infringed upon;

A detailed description of where the material that you claim is infringing is located on the Site;

Your address, telephone number, and email address;

A statement by you under penalty of perjury that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

A statement by you under penalty of perjury that the above information in your notice is true and correct and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

This procedure is exclusively for notifying Gathered Home that your copyrighted material may have been infringed.

REFUNDS AND RETURNS POLICY

We offer returns for most items within 15 days of receipt of shipment.

Holiday Return Policy

Items shipped by Gathered Home between November 1, 2016 and December 31, may be returned until January 15, for a full refund, subject to our other return guidelines listed below.

Gathered Home Return Policy

Items shipped from Gathered Home can ordinarily be returned within 15 days of receipt of shipment in most cases. All orders received after the 15 days and up to 45 days will be issued store credit. We cannot accept returns after 45 days. Custom orders, gift cards, design services and items marked as Final Sale are non refundable. All returned items must be in their original, unused condition and in the original packaging in which they were received. Any item that does not meet this requirement may not be eligible for a refund or will be subject to a restocking fee. Some products have different policies or requirements associated with them.

Fine Art

Fine Art items with a value of $75 or more must be returned using a trackable shipping method. Items with a value more than $500 must also be insured.

All product packaging (boxes, etc.) and certificates of authenticity and appraisal must be returned with the item. Any Fine Art item returned without original documentation will be rejected.

Any Fine Art items that have been damaged, or otherwise altered after delivery, won’t be accepted for return. Before sending a Fine Art return, photograph the item for your records.

Handmade by Gathered Home

If there is a misspelling or error in the configuration, inscription, or design due to a mistake by Gathered Home (e.g., not the result of a transcription error on your part), we will remedy the error and pay for your shipping costs at no additional charge.

All product packaging (such as boxes) and if applicable; certificates of authenticity, grading, and appraisal must be returned with the item. Products without all applicable tags are not acceptable for returns on custom, handmade products that have had different customization options, including any configurations, inscriptions, or designs (such as engravings, stamps, monograms, embroidery, embossing, etching or carving) are as follows:

You must notify Gathered Home within 7 days of receipt.

Due to personal configuration, inscription, or design on these products, Gathered Home is not required to accept returns or exchanges unless the products are damaged or defective upon arrival.

Jewelry

Jewelry items with a value of $75 or more should be returned using a trackable shipping method.

All product packaging (boxes, manuals, warranty cards, etc.) and certificates of authenticity, grading, and appraisal must be returned with the item. Any items returned without original documentation will be rejected. Items that have been resized, damaged or otherwise altered after delivery will not be accepted for return.
